Terms of Use
These Terms of Use ("Terms") are an agreement between you and Petvival LLC ("Petvival," "we," "us," or "our") and govern your use of the Petvival mobile app, the website at petvival.com, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
1. Eligibility and accounts
You must be at least 13 years old to use the Services, and if you are under the age of majority where you live, you must have a parent or guardian's permission. You are responsible for keeping your login secure and for activity under your account. Please give accurate information and keep it up to date.
2. Not veterinary advice
Petvival helps you organize and share your pet's health information. It does not provide veterinary diagnosis, treatment, or advice, and it is not a substitute for a licensed veterinarian. In an emergency, contact your veterinarian or an emergency animal hospital immediately.
3. AI-powered features
Some features use artificial intelligence to summarize or extract information. AI output may be incomplete or inaccurate. You are responsible for reviewing it against the original records before relying on it. AI features are optional and are used only with your permission.
4. Travel information
Petvival helps you organize documents for pet travel. Travel requirements are set by governments, airlines, and other authorities and can change at any time. You are responsible for confirming current requirements with official sources. We are not responsible for denied travel, quarantine, or other consequences of incomplete or outdated documents.
5. Your content
You own the information, records, photos, and documents you add ("Your Content"). You give us a limited license to host, store, process, and display Your Content only as needed to provide and improve the Services for you, and to share it when you ask us to. You confirm you have the right to upload Your Content, including any information about other people such as veterinarians or emergency contacts.
6. Acceptable use
You agree not to misuse the Services. For example, you will not break the law, upload malicious code, try to access other users' data, interfere with or overload our systems, reverse engineer the App except where the law allows, or use the Services to harass anyone or to store unlawful content.
7. Subscriptions and payments
Some features may require a paid subscription. Purchases are made through Apple's App Store and are subject to Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel in your Apple account settings. Prices are shown in the App before purchase. Refunds are handled by Apple.
8. Our intellectual property
The Services, including the Petvival name, logo, design, and software, belong to Petvival LLC and are protected by law. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on Apple devices you own or control, in line with these Terms and the App Store Usage Rules.
9. Termination
You can stop using the Services and delete your account at any time in the App under Settings > Account > Delete Account. We may suspend or end your access if you violate these Terms or if needed to protect the Services or other users. Sections that by their nature should survive termination will survive.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Services will be uninterrupted, error free, or that data will never be lost, so please keep copies of important original documents.
11. Limitation of liability
To the fullest extent permitted by law, Petvival LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the Services. Our total liability for any claim related to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50. Some places do not allow these limits, so they may not apply to you.
12. Indemnity
You agree to defend and hold harmless Petvival LLC from claims arising from Your Content or your violation of these Terms, to the extent permitted by law.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, unless the law where you live requires otherwise.
14. Apple App Store terms
If you downloaded the App from the Apple App Store, you also agree that: (a) these Terms are between you and Petvival LLC only, not Apple; (b) Petvival LLC, not Apple, is solely responsible for the App and its content; (c) Apple has no obligation to provide maintenance or support for the App; (d) if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, and Apple has no other warranty obligation; (e) Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims; (f) Apple is not responsible for any third-party claim that the App infringes intellectual property rights; (g) you represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Changes to these Terms
We may update these Terms from time to time. If changes are significant, we will notify you in the App or by email before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms.
